Terms of service

The agreement

These terms are between eNsight and the organization that opens an account. Where an individual accepts them, they confirm they are authorised to bind that organization.

By creating an organization, inviting members or using the service, you accept these terms. If you don't accept them, don't use the service.

Plans and payment

eNsight is offered on a subscription basis. The plan you choose sets what the service includes and what it costs, and those details are shown before you subscribe.

Fees are billed in advance for the period you select and are not refundable except where the law requires it or where we have failed to provide the service. Where we change our prices, existing customers get at least 30 days' notice before the change applies to them.

Where a plan is offered free of charge, we may change or withdraw it with reasonable notice.

Accounts and your team

You are responsible for who you invite, what role you give them, and for removing people who leave. Accounts are personal and must not be shared between people.

You are responsible for what happens under your accounts, including the conduct of your field agents in the app. Tell us promptly if you believe an account has been compromised.

Your data stays yours

Everything you put into eNsight — campaigns, visits, photographs, reports — belongs to your organization. We claim no ownership of it.

You grant us only the permission needed to run the service for you: to store your data, process it, display it to the people you have authorised, and produce the reports you ask for.

You can export your data at any time while your account is active. See the privacy policy for what happens to it after an account closes.

What you must not do

When using eNsight you must not:

• Upload anything unlawful, or anything you don't have the right to upload.
• Record location or photographs of people without the notice and consent your local law requires.
• Attempt to access another organization's data, or probe or interfere with the service's security.
• Resell or white-label the service as your own without a written agreement with us.
• Use the service to build a competing product.

Your obligations to your own team

eNsight records where your agents are when they check in. Before you deploy it, you must tell your field team that this happens and have a lawful basis for it under the employment and data protection law that applies to them.

This matters and we will not pretend otherwise: it is your responsibility, not ours, and it is the term most likely to cause you a problem if ignored.

Availability

We work to keep eNsight available and quick, but we don't promise it will never be interrupted. We may take it down for maintenance, and we'll give notice where we reasonably can.

The field app is built to keep working without a network and to send queued work once a connection returns. That is a design goal we take seriously, not a guarantee against every possible device or network failure.

Ending it

You can cancel at any time, and your subscription will run to the end of the period you've paid for.

We may suspend or end an account that breaches these terms, that doesn't pay, or that puts the service or other customers at risk. Except in serious cases we'll warn you first and give you a chance to put it right.

On termination you lose access to the service. Export anything you want to keep beforehand.

Liability

The service is provided as it is. To the extent the law allows, we exclude implied warranties.

Neither party is liable for indirect or consequential loss, or for lost profits, revenue or goodwill. Our total liability in any twelve-month period is limited to the fees you paid us in that period.

Nothing here limits liability that cannot lawfully be limited, including for fraud or for death or personal injury caused by negligence.

Changes, law and contact

We may update these terms. If a change materially affects you we'll give account holders notice by email before it takes effect, and update the date on this page. Continuing to use the service after that means you accept the new terms.

These terms are governed by the laws of the Federal Republic of Nigeria, and the courts of Lagos have exclusive jurisdiction over any dispute.
